A INFLUÊNCIA DO CRITÉRIO DA SOBERANIA NAS FONTES DO DIREITO INTERNACIONAL

Durante muito tempo, o pressuposto de não submissão do Estado senão às proposições admitidas por ele mesmo como direito confortava a ideia de uma sociedade orientada segundo uma lógica sistêmica positivista que tinha no voluntarismo a expressão mais bem-acabada da noção de soberania. Em tal panorama, é inexorável a ligação entre soberania e produção jurídica. Diante desse contexto, tendo presente as limitações das fontes clássicas do direito internacional para solucionar todas as controvérsias que afetam a sociedade internacional na atualidade, o presente artigo tem como propósito analisar a evolução dessas fontes com base na flexibilização do critério da soberania, pedra angular da edificação do sistema vestfaliano. Para tanto, inicialmente enquadra-se a ideia de soberania na categoria de “palavra viajante”, redefinindo seu conteúdo à medida que eventos disruptores da ordem estabelecida demandavam uma adaptação para que a lógica sistêmica se mantivesse operante. Num segundo momento, entrecruzam-se as principais alterações a impactarem a noção de soberania e sua influência na formatação de uma nova estrutura social sujeita ao império do direito internacional. Na sequência, destaca-se a incidência desse processo nas fontes do direito internacional. Ao final, apresentam-se breves considerações a respeito da influência do critério da soberania nas fontes do direito internacional.

ABSTRACT

For a long time, the assumption of non-submission of the State, rather than to the propositions accepted by it as a right, reinforced the idea of a society oriented according to a positivist systemic logic that had in voluntarism the most well-finished expression of the notion of sovereignty. In such a scenario, the link between sovereignty and legal production is inexorable. In view of this context, bearing in mind the limitations of the classical sources of international law to solve all the controversies that affect international society today, this article aims to analyze the evolution of these sources based on the flexibilization of the criterion of sovereignty, cornerstone of the westphalian system. In order to do so, the idea of sovereignty in the category of "traveling word" is initially defined, redefining its content as disruptive events of the established order demanded an adaptation so that the systemic logic remained operative. Secondly, the main changes that impact the notion of sovereignty and its influence on the shaping of a new social structure subject to the rule of international law are intertwined. Following, the impact of this process on the sources of international law is analyzed. In the end, brief considerations are presented regarding the influence of the criterion of sovereignty on the sources of international law.
