Destaca-se que não apenas a família se modificou, ao longo do século XX e XXI - mas a própria estrutura social, que se tornou extremamente complexa em razão, principalmente, das transformações industriais e tecnológicas. Os novos nichos de mercado fizeram com que houvesse a ampliação de diversas modalidades de exploração da atividade econômica, o que culminou no aumento significativo das espécies societárias, bem como no número de pessoas que passaram a desenvolver atividades empresariais. Infere-se, portanto, que o corpo social se encontra cada vez mais urbano e empresarial. Tal característica social, cumulada com o aumento das rupturas dos vínculos afetivos, quer seja do casamento ou da união estável, fizeram com que o número de demandas litigiosas envolvendo a partilha da participação societária de um dos cônjuges aumentasse significativamente. Pretende-se, portanto, por meio do método teórico, apresentar o desenvolvimento e modificação do conceito de família ao longo dos anos para, posteriormente, analisar os regimes de bens e seus reflexos tanto na constituição das sociedades, quanto na partilha das quotas sociais.

ABSTRACT

Highlights that not only the family change, throughout the 20th century and 21st century-but the social structure itself, which has become extremely complex because, mainly, of the industrial and technological developments. The new niche markets meant that there was the expansion of various modes of exploitation of the economic activity, which culminated in significant increase of species reorganizations, as well as in the number of people who began to develop business activities. Infer, therefore, that the social body is increasingly urban. Such social feature, cumulated with the increase in ruptures of affective ties, whether marriage or stable Union, caused the number of conflicting demands involving the sharing of equity interest of a spouse increases significantly. It is intended, therefore, through the theoretical method, present the development and modification of the concept of family to subsequently analyze the property regimes and their reflexes in both the Constitution of societies, as in sharing social quotas.
