A UTILIZAÇÃO DO TRABALHO DE ESTAGIÁRIOS SEM A OBEDIÊNCIA DOS REQUISITOS LEGAIS: REAL APRENDIZADO OU VINCULO EMPREGATÍCIO DISFARÇADO?

Este artigo, resultado de pesquisa realizada junto ao Poder Judiciário em Pelotas, busca avaliar a aplicabilidade, ou não, da Lei nº 11.788/08. Realizou-se várias entrevistas com estagiários da Justiça Comum, Justiça Federal e Justiça do Trabalho, na cidade de Pelotas, RS, cujo instrumento de pesquisa verificou se os principais requisitos da lei do estágio estavam sendo cumpridos pelos Entes Públicos que contratam esse trabalho na modalidade de estágio. Para tanto, utilizou-se os institutos do Direito do Trabalho, que dão suporte e caracterizam o vínculo empregatício, buscando demonstrar que na majoritária parcela dos casos examinados não se trata de estágio, mas sim de vínculo empregatício mesmo que dissimulado sob o manto do estágio.

ABSTRACT

This article, research results conducted by the judiciary in Pelotas, aims to assess the applicability or not of Law No. 11,788 / 08. We conducted several interviews with trainees Common Justice, Federal Court and the Labor Court in the city of Pelotas, Brazil, whose research instrument verified that the main stage of the law's requirements were being met by public entities that hire this work in the form stage. Therefore, the institutes was used of labor law, which support and characterize the employment relationship and attempts to demonstrate that the major share of the cases examined it is not stage, but the employment contract even if hidden under the stage mantle.
