La Transparencia Administrativa: principio rector, ineludible, del actuar administrativo y garante de los derechos de los administrados

RESUMEN

La transparencia administrativa ha sido y sigue siendo, hoy en día, una fuente de constantes preocupaciones y problemas para los Estados, dado que, resulta, sumamente complicado, encontrar el justo equilibrio entre aquella y la reserva lógica (limitaciones y excepciones) que demanda toda Administración Pública. Con la finalidad de valorar, debidamente, la situación actual en que se encuentra la transparencia administrativa, hemos analizado la evolución seguida por la misma, concluyendo, que se ha caracterizado, por ser: Unidireccional y creciente. Por otro lado y en íntima unión con ella, hemos querido traer a colación, el Derecho de acceso a la información en materia medioambiental, dado que, el mismo, es el máximo exponente de la transparencia administrativa, y entendemos, que modelo a seguir.

ABSTRACT

The administrative transparency has been and is, nowadays, a source of constant worries and problems for the States, provided that, it proves, extremely complicated, to find the just balance between that one and the logical reservation (limitations and exceptions) that demands any Public Administration. With the purpose of valuing, due, the current situation that is the administrative transparency, we have analyzed the evolution followed by the same one, concluding, that has been characterized, for being: Unidirectional and increasing. On the other hand and in intimate union with her, we have wanted to bring to collation, the Law of access to the information in environmental matter, provided that, the same one, is the maximum exponent of the administrative transparency, and understand, that I shape to continuing.
