AS DECLARAÇÕES DE DIREITOS DA OIT E SUA REPERCUSSÃO NA FUNDAMENTAÇÃO E NA PRÁTICA DA MISSÃO DE JUSTIÇA SOCIAL DO PODER JUDICIÁRIO TRABALHISTA

Resumo

Objetivo: este artigo pretende analisar, com base em amostra jurisprudencial metodologicamente selecionada, a existência (ou não) de um padrão jurisprudencial representativo do Tribunal Superior do Trabalho quanto ao manejo das Declarações de Direitos da OIT na fundamentação e na prática da missão de justiça social do Poder Judiciário Trabalhista.

Metodologia: Apresenta-se uma ilustração metódica dos parâmetros jurisprudenciais trabalhistas que dialogam de forma consistente com a matriz constitucional de 1988 e com os Direitos Humanos e o Direito Internacional do Trabalho, precisando em que medida as Declarações de Direitos da OIT repercutem na fundamentação e na prática judicial do Direito do Trabalho brasileiro. Nesta pesquisa, o acervo jurisprudencial compilado limita-se ao TST, em razão de sua representatividade perante o Poder Judiciário Trabalhista brasileiro e por ser o responsável pela uniformização da jurisprudência trabalhista do País.

Resultados: o padrão decisório do TST em temas vinculados ao Direito Internacional do Trabalho ainda é construído, na perspectiva do Direito Internacional, com suporte quase exclusivo no sistema da hard law, ou seja, com base nas Convenções Internacionais da OIT que foram ratificadas pelo Brasil. No campo da regulação judicial trabalhista, a aplicação das Declarações de Direitos da OIT nas decisões do TST ainda é um desafio, circunstância que reduz a possibilidade de interseção ampla entre as normas da OIT e as normas domésticas.

Contribuições: o presente estudo contribui com o esclarecimento sobre como as diretrizes internacionais de proteção ao trabalho da OIT, transmitidas por meio de suas Declarações de Direitos, são eventualmente articuladas pelo TST.

ABSTRACT

Objective: this paper intends to analyze, based on a methodologically selected case law sample, the existence (or not) of a case law standard representative of the Superior Labor Court regarding the handling of the ILO Bills of Rights in the foundation and practice of the social justice mission of the Labor Judiciary.

Methodology: a methodical illustration of the labor jurisprudential parameters that dialogue consistently with the 1988 constitutional matrix and with Human Rights and International Labor Law, specifying the extent to which the ILO Bills of Rights affect the rationale and judicial practice of Brazilian Labor Law. In this research, the jurisprudential body compiled is limited to the Brazilian Labor Superior Court - TST, due to its representation before the Brazilian Labor Judiciary and for being responsible for standardizing the country's labor jurisprudence.

Results: the decision-making standard of the TST on issues related to International Labor Law is still built, from the perspective of International Law, with almost exclusive support in the hard law system, that is, based on the ILO International Conventions that were ratified by Brazil. In the field of labor judicial regulation, the application of the ILO Bills of Rights in TST decisions is still a challenge, a circumstance that reduces the possibility of a broad intersection between ILO norms and domestic norms.

Contributions: this study contributes to clarifying how the ILO's international labor protection guidelines, transmitted through its Bills of Rights, are eventually articulated by the TST.
