Violência e mediação: impressões jusfilosóficas.

RESUMO

A violência marca a sociedade atual de uma forma nunca verificada em outros tempos. Seu espaço nos caminhos do homem atual tem se intensificado de modo a exigir uma reflexão de fundo, com vistas à sua aniquilação, ou, ao seu controle. É notável o insucesso da teoria moderna com alicerces greco-romanos, juntamente com a ideia de contrato social, de instrumento normativo como regulação da violência. Diante desta impossibilidade de resposta à violência pela norma, e todo o aparato jurídico, o velho tema grego da mediação tem reaparecido e se colocado, como um lugar interessante de diálogo com a violência, voltado muito mais a redescobrir mecanismos para que a violência seja falada e metabolizada, ao invés, como sempre o quis a racionalização da modernidade, silenciada. Diante disso, torna-se necessário estudar a fundo a origem da mediação, desde suas bases gregas e seu lugar pós-positivista de elemento de regulação da violência.

ABSTRACT

The violence marks the current society in a way never seen at other times. The space taken in the ways of modern man has intensified, requiring deep reflection, seeking its annihilation, or at control. It is notable failure of the modern theory with Greco-Roman foundations, along with the idea of social contract normative instrument to regulate violence. Given this inability to respond to violence by the standard, and the entire legal apparatus, the old Greek theme of mediation has reappeared and is placed as an interesting place for dialogue with violence, geared more to rediscover mechanisms that violence is spoken metabolized and, instead, as usually wanted, rationalization of modernity, silenced. Therefore, it becomes necessary to study in depth the origin of mediation, from the Greek basis and it’s place post-positivist as the element of regulatory of violence.
