AS CONSTITUIÇÕES EM TEMPOS DE TRANSFORMAÇÕES SOCIAIS: O ACOPLAMENTO ENTRE O DIREITO E A POLÍTICA

O presente artigo tem como propósito entender como se produz o acoplamento do Direito e da Política por meio das Constituições. Possui, como marco, a teoria dos sistemas sociais autopoiéticos aplicada ao Direito (TSAD). Partindo de uma observação sociológica, constata-se que a validação do Direito ocorre internamente, permitindo um reconhecimento do jurídico pela código constitucional/inconstitucional. Nesse sentido, as Constituições fazem tal filtro, isto é, permitem que as Constituições e “constituam” em acoplamentos estruturais do Direito e da Política com base em processos comunicativos que ocorrem entre sistemas funcionalmente diferenciados. Tais processos, representam, para o sistema do Direito, a tradução das comunicações existentes entre o sistema social e o sistema político. Também se apresentam como uma orientação de uma demarcação do poder e de sua legitimidade. A pesquisa, apoiada pela obra de Niklas Luhmann, está dividida em três partes. Em um primeiro momento, apresenta-se o marco teórico escolhido e o ponto de observação dos fenômenos. Em um segundo momento, explica-se a ideia de acoplamento estrutural a partir da TSAD. Por fim, aborda-se a relação entre o sistema da Política e o Direito por meio das Constituições.

ABSTRACT

The purpose of this article is to understand how the Coupling of Law and Politics is produced through the Constitutions. It has, as a landmark, the theory of autopoietic social systems applied to Law (TSAD). Starting from a sociological observation, it is verified that the validation of the Law occurs internally, allowing a recognition of the legal by the constitutional / unconstitutional code. In this sense, the Constitutions make such a filter, that is, they allow the Constitutions and "constitute" in structural couplings of Law and Politics based on communicative processes that occur between functionally differentiated systems. These processes represent, for the system of law, the translation of existing communications between the social system and the political system. They are also presented as a guideline of a demarcation of power and its legitimacy. The research, supported by the work of Niklas Luhmann, is divided into three parts. At first, the theoretical framework chosen and the point of observation of the phenomena is presented. In a second moment, the idea of structural coupling from the TSAD is explained. Finally, the relationship between the system of politics and law through the Constitutions is discussed.
