O princípio da autonomia da vontade das partes é amplamente consagrado nos ordenamentos jurídicos dos Estados e que, em tempos de globalização, facilitam o acesso aos investimentos internacionais, tendo em vista a maior segurança jurídica atribuída para as partes, no sentido de se buscar a melhor lei, o melhor idioma, a melhor sede para regulamentar uma relação jurídica contratual e, consequentemente as melhores regras para dirimir eventuais controvérsias. Neste ponto de vista, inquestionavelmente a arbitragem surge como um importante instituto dentro do Direito Internacional Econômico, de forma a permitir às partes o direito fundamental de, livremente escolher a lei a ser aplicável em uma relação contratual, desde que não exista fraude à lei ou violação à ordem pública.

ABSTRACT 

The principle of the parties will autonomy is widely enshrined in the legal systems of States and, in times of globalization , facilitating access to international investments , with a view to greater legal certainty attributed to the parties in order to seek the best law , the best language, best thirst to regulate a contractual legal relationship and consequently the best rules to settle any disputes . In this view , unquestionably arbitration emerges as an important institute in the International Economic Law , in order to allow the parties the fundamental right to freely choose the law to be applicable in a contractual relationship , provided that there is circumvention of the law or violation of public order .
